"On March 26-28, 2010, I ran an advertisement on Groupon for a $75 spring clean-up. I’ve included a copy of the ad for reference. The ad clearly states that the maximum lot size was 5,000 square feet. The member’s lot size, per the Cuyahoga County Auditor’s website, is 23, 828 square feet. I went to the member’s residence to view the property, as I did with all customers who purchased with a lot size over the maximum, ad advised him that to clean the entire lot as specified in the Groupon it would be an additional $275. As per the groupon, we would remove leaves/debris from lawns and flowerbeds, trim bushes/shrubs, remove any dead plants/foliage, and haul all the debris away. The Groupon did not address cleaning of any type of water feature, nor does my company do this unless specifically requested. Upon arrival on April 24, I walked the yard with the member to discuss all the work that was going to be done so we were both on the same page. At that time the pond was not discussed. On April 25, I received an email from the member stating his issues/complaints. Despite the fact that I do not clean water features or ponds, I sent a crew out on May 3 to address the member’s concerns as well as ensure that the pond was cleaned. Cleaning the pond was not quoted in the original contract, nor have I attempted to collect additional funds for cleaning the pond from the member as I have been willing to work with him. I sent the member a follow-up email to his issues/complaints since my crew was out the second time and I have yet to receive a response."
