"Maybe fraud? One would think, as an attorney you would understand the scope of work you agreed to. There was no cost to you whatsoever, as you have refused to pay for work which was clearly written on the proposal you received when you hired us. If you did not understand the scope of work, I believe that it was your responsibility to have that made clear before you agree to it. We did EXACTLY what you hired us to do and you refuse to pay a nickle for it (fraud ?). The professional climber who did the work has 25 years experience, so again, perhaps you should have asked if you did not understand the agreement. There is nothing wrong with the work, the tree was far overgrown and I sincerely thought that you had received notice from the county to trim it off of the sidewalk and street, which it was encroaching. It's interesting that you state that we might be fraudulent. In the field of psychology, it is well know that people actually project their own attributes onto others. Maybe you hired us under the guise that you were actually going to pay for work that you were being forced to have done. Also, I believe you likely have Borderline Personality Disorder, as it is unsound for one professional to communicate with another by calling and cussing them out!"

Several weeks go by, and my neighbor asks me again about the tree. I e-mail Merriman on 9/10 because I was leaving for vacation that weekend and wouldn't be back for a few weeks. Mary Ann said she'd make sure it was done before I left. Unfortunately, the men who worked on my tree didn't call me before they came out, so I wasn't home. They called me after the completion of work and I was still out. I happened to catch them as they were almost leaving. There were two men, only one really talked to me. If they had called prior to work, I definitely could have made it home.
The tree was definitely off my and my neighbor's houses, but in the past when I'd gotten it done it looked ... nicer (for lack of a better term). There was an odd branch hanging off to the side, which the man admitted they probably should have cut off (I got the impression that if they hadn't been already packed up he probably would have done it). My biggest concern was that the tree looked like it was going to touch my neighbor's house again next year. The first time I had the tree cut I was told I wouldn't need to trim again for another 2-5 years. The man assured it me that I wouldn't need to trim again for around the same amount of time. When I asked about the tree still not looking that great, he said the tree needed lateral thinning, that the tree had been topped before and that's why it looked so bad now. Positive: I definitely felt like he was an expert in tree work.
I asked how payment worked and whether I was to wait for an invoice. The man didn't really know and said to just wait.
When I got back from vacation I related all of this to Mary Ann and she sent me a prompt reply apologizing for not calling, explained that the work order needs to say I wanted the lateral thinning, and she doesn't include any additional work, with the initial proposal as not to try to and quot;selland quot; more services than one is asking for. Unfortunately, I'm certainly not a tree expert, all I knew is that I needed the tree off the house to make my neighbor happy.

I asked for more proposals for tree trimming, and she responded professionally and promptly, and again did excellent work. I highly recommend Merriman.

The only glitch with this provider was that we weren't sent an estimate when we were told we would receive it. The owner of the company apologized...she thought she'd sent it but hadn't. We received the estimate the night before the work was to be done...it was part of a much larger job for our next door neighbor...they were having more trees trimmed and two removed. That large job was scheduled, and we were told the night before. We weren't entirely happy with the situation because we had been told our driveway would be needed for the crane. As it turned out, our driveway was not needed. All went well and we were happy with the final job and clean-up. We would call this company again.
The men who did the work were professional and polite.
I think the tell tale sign of a good company is when they run into unexpected costs but still honor the original contract. This happened on the job that they did at my personal residence. The original quote did not contemplate the use of a crane but I suppose with the wind gusts on the day of the removal, they felt that the safe thing to do was to bring in a crane. I was impressed.
Merriman quoted the job about $1000 lower than the others.
