Avon Paving & Roofing

My father and I met with Larry Miller Jr. (Who presented himself as the owner) and we outlined what we wanted done and what our budget was. As we walked around Larry pointed out a lot of concrete that needed fixed and eventually gave us a quote for around $5000. We told him our budget for everything was $4000. We eventually agreed on $4180 which was a competative rate. We also agreed that as a deposit I would pay for the concrete directly when it showed up and write a check to avon paving for $1000 the day that the ASPHALT work started. They did not begin the work until 3 days after promised (at 6 pm) which caused an issue with the timing of a tree that was to be romoved by the city. They showed up with no excavation equipment other than hand tools and an antique asphalt roller that was missing its battery. They would swap a battery between one of the work trucks and the roller as needed (not a big deal just trying to paint the big picture of the type of operation they are running). From the get-go Larry Jr began bugging me for the deposit however all that had been done was the removal of concrete. I agreed to give him $500. At this point, after removing all of this thick concrete by hand, the crew began to become very frustrated. At one point they walked off the job with several tons of stone left piled in the street. The Lakewood dept. of public works had to call them to come back and remove it or they would be violated. After the first driveway was 80% paved I gave him another $500. My father was then contacted by the company and told that we would need to come up with another $1200 (in addition to the original $4180) to complete the job. They wanted to have a meeting to discuss it. I told them there would be no meeting and that we had a contract. I was then told by Larry Jr that "mistakes were made" and that they lost their account with the asphalt supplier and I would now have to pay for the asphalt directly along with paying his workers directly by the hour as he was "broke". I agreed to do this just to get the job done. They said they would show up the following day. 2 days later I was told that their trucks were stolen and they couldn't make it. I tried every way possible to confirm this story (called Cleveland P.D. with plate numbers etc....they said there was no report. We were also give the number of an officer to call who could confirm the story....the number went to a residential voicemail). Today I met Larry Sr.....the actual owner of the "broke" company who pulled up in his Mercedes convertible. He began by accusing myself and my father of taking advantage of his son (I'm not making this up). Two inspectors of the Lakewood Building Dept. walked the site with us and informed us on what had to be done by Avon Paving to complete the job as per the contract. When the inspectors left, Larry Miller Sr. said "I guess we'll deal with this in court...." he then called my father and I some names and sped off.
