I was told on purchase that there was a one year warranty on this $200 tree. This was important to me because I was uncertain as to how hardy this tree might be and I wanted to be certain to be able to replace it if it did not winter well. I called the owner in May of 2011 as the tree did not come back well the next spring and was told that they do not warranty their products. Not only did the owner argue with me, but I could barely get a word in edgewise to plead my case. Finally, after I instructed him a bit on customer service he stated that he would allow me a 50% credit on a purchase of equal value. This was okay, however I questioned the wisdom of spending another $100 with an establishment that does not extend warranty on its products. Then I find out that he no longer carries trees or shrubs, so I guess I am supposed to purchase $200 of pansies in place of a tree. Obviously, I will take my business elsewhere and I caution you to do the same.

The Gardener of Bath has never offered a one year warranty on trees and shrubs since we opened in 2006. We have never promised a customer, including the one who filed this complaint, a warranty on any tree. We feel that most trees and shrubs, especially certain ornamentals like the Japanese Maple described in the complaint, require special care in order to survive. The placement of a tree, how deep the tree is planted, the soil it is planted in, how much sun or shade the tree receives, and whether the owner waters the tree properly,a re all variables that we cannot control once the tree leaves the nursery. People familiar with ornamental trees will likely acknowledge that Japanese Maples can be quite fickle. The tree mentioned in the complaint was a cut leaf Japanese Maple, which is extremely delicate. Even advanced gardeners often struggle with these varieties. When someone plants a cut leaf Japanese Maple, or any plant for that matter, there is always some risk that the tree will not survive the winter. Even though we never guaranteed the customer's tree, I offered her a credit on any store merchandise for half the value of the tree she had purchased.
