Real Estate Service
Contacted realtor Wednesday august 13, 2014 to list property. They
took property information and said they would list on August 18
[verbally and on contract form].
The day I visited the realtor, my
tenant at the property told me that the neighbor had an interest in
purchasing. Talked with the neighbor that day, confirmed his interest
Texted the realtor immediately asking that they exclude that individual from our
'Exclusive right to sell' agreement. [essentially asking that IF I sell
to MY customer, no commission go to the realtor, since my customer
contact occurred BEFORE the start date of the contract or the listing].
Realtor refused saying that they would accept a lesser percentage of commission if MY customer purchased.
2 weeks after the start of the listing, a second prospective buyer
contacted me. He began to make an offer. I referred him to the realtor, telling him that all offers had to be presented by Century 21. He said "I asked them about your property a week ago and they never
showed it to me, so I got your phone from my uncle". Subsequently, the
realty salesperson telephoned asking if I had received any calls. I
said "yes". She named the fellow who called and apologized for showing
other properties and not mine.
I met with the owner/manager of the
agency in person. She listened politely as I showed her the contract
start date and asked that she exclude my customer in writing. She said
she would gather facts and get back to me.
I waited weeks, with no
contact. When I called her office, her secretary would ask my name, pause and then tell me, she would be "out","on the other line", etc.
Suspecting that she was avoiding me, I called with an alias and got her
first try! She said her salesperson contacted my customer and therefore
she would not exclude him for our contract.
I told this to my customer who said "she's nuts! I was never contacted by her or any other realtor"
