My financial situation changed and I was unable to get a mortgage. I sent a letter to the company within the official time period and they said that I was in breach of contract because I didn?t file for a mortgage within 10 days of the signing of the contract. This was at a time where there was an onslaught of applicants because of a new tax credit. Adrienne, a representative of the company, told me to wait a bit longer because the markets change. So under her advice I waited. They claim I defaulted in the contract but I provided them with a letter of good faith from the mortgage company and a letter of the mortgage denial with in the 60 day contract period. The construction of the house is still not completed therefor, it is obvious that I did not prevent them from selling the house in any way. I gave them proper notice, as illustrated in the contract and my situation has in no way prevented them from selling the house. In January 2011, I called them regarding the refund. I told them I was not being represented by an attorney and was going about things on my own and they lowered the offer on the house. I then went to look at the house and after having a licensed general contractor examine some questionable spots on the property, I decided not to go into contract with Opal Ridge because of flaws found in the concrete. The licensed contractor advised me that the four cracks in question would cause considerable trouble in the future. The issue was in a retaining wall that was in the hill that would separate my property from my neighbors. They said that they would fix the cracks in the concrete if I signed an amendment to the prior contract stating that if the new contract somehow failed, I would not be entitled to the original $30,000. I told them I would consider signing the contract if they would change the word ?fix? to ?replace?. They wouldn?t agree to do this and said they were only willing to repair the concrete not replace it. Randy Lee who is the seller told me the deal was off. A week later I received a phone call at home from Adrienne Setbon (a representative of Opal Ridge) and offered to amend the contract. She said I could provide my own engineer to look at the problem and then Opal Ridge would abide by what my engineer said but in order to do this I had to sign the amendment. After two days of consideration I decided that I did not want to deal with this company any more. My faith and confidence in the company had been shaken and I decided that I no longer was interested in the house. I once again requested a refund of the $30,000 and again the company did not respond.
