WILL PAULSON WOODWORKS INC

Paulson was hired in February of 2012 to mill three extremely valuable 20-25 foot high and 24-36in diameter black walnut trees. As he does not carry any insurance on his Mattituck lumberyard, we agreed that the logs would be milled posthaste and returned to us for storage on our property, which is insured for damage or loss. We paid him $1000 to buy equipment for the milling in Feb of 2012. He agreed to return the wood to our property for free. For almost one and a half years after the wood was delivered to him, Paulson did not mill it. It laid in his yard during Sandy and covered with snow. Despite forcing us to store our valuable lumber on his uninsured property, and being 15 months late in delivery, he then demanded to be paid the full outstanding amount of $1000. He also refused to deliver the wood, which he had previously agreed to do. Paulson did not provide any measurements, board footage estimates and did not mark our wood in any way so as to identify it, although he was requested to do so. After milling he flat out refused to provide an estimate of board footage that was yielded. Over the course of a year and half, we contacted Paulson by email and telephone repeatedly. He was unresponsive. and ignored almost all of our numerous requests for status updates. On six occasions he promised completion of the milling and delivery and then failed to follow-through. We had to arrange for delivery, at an additional cost of $500, which was contrary to our agreement that Paulson would return the wood to us free of charge. Paulson placed photos of our lumber on his Facebook page. These photos received a "thumbs-up" sign from a friend of his who runs a high-end flooring supply store in CT. Over the course of the 15 months delay, he also executed a commission for a black walnut sculpture; in the Suffolk Times news item about this artwork, he claimed that he got this valuable wood from public property in Riverhead for free. We could not help but feel that we were being ripped off, and that lumber was taken from us, given his refusal to mark our wood for identification purposes or supply board footage.
