I had hired Merill Greenberg (doing business as Capital Asset Management) to manage a rental property I owned. In February of this year (2012), I became unhappy with the way he was doing things and replaced him with a manager. I asked him to return my money, the tenants had given him for rent deposits and pre-paid rents. He ignored my requests and never responded. I took him to small claims court and the judge awarded me $5,000. The case was heard in City Court of Troy, NY on July 10, 2012. The judge was Matthew Turner. Mr. Greenberg has ignored the court order and has still not paid. I am now in the process of trying to put a lien against his bank accounts. In addition to managing rental property, he also acts as a real estate broker for people buying and selling their homes. I would strongly recommend that anyone who is buying or selling a home avoid business with him. He might cheat them, and even if they take him to court and win; they'll still have trouble collecting their money.
