Project Guaranteed

Description of Work: The owner of Project Guaranteed" is Howard Pompeo. I hired him to construct a patio, and the contracted price is 5,000. According t the contract, I pay him half in the start, and 1/4 when the concrete is paved, and another 1/4 when the job is finished with satisfaction. Howard Pompeo started the project on April 21, but asked for $3000, claiming he needs additional $500 for the materials. I paid $3,000 to him. He cleaned the ground, put one inch of stone base (the contract says 2-3 inches), then stopped. He promised to complete the job in 4 days. I called him every sunny day to ask him to come to work. He keeps saying he will come, but never show up. Then on May 12, three weeks later, he showed up, but asked for additional $1,000. I declined for the reasons that I have not seen any concrete on the ground and that I cannot trust him since he has not shown up for completing the project for so long. I promised that when I see the concrete is paved, I'll pay him immediately. He was mad, and packed the tools and walked away. I called him again and he replied that "no money, no concrete." I wrote him a letter on May 14, asking him to show up to finish the job in 10 days (May 23). Otherwise the contract is
