After several months of the owner or salesman refusing to provide us with a date they would complete our unfinished job (less than one day's work), we were forced to sue Ceramic Tile & Natural Stone and Marcos Porras (the owner) for breach of contract. (The response they provided to our BBB complaint included the following "We fully understand we need to finish the first portion of the project as agreed with the client. We have not had the opportunity to travel the 200+ mile round trip to finish our work.") The court ruled in our favor and awarded us the full judgment we had requested. Don't believe us, look at the On-line Case Lookup on www.nmcourts.com and you'll see our lawsuit among the many others which have been filed against the business and individual owner. Because they still have not paid our judgment, we are now pursuing payment through New Mexico Construction Industries Division. If they don't pay (we are just one in a very long line of creditors), we will be pursuing having their license revoked. We don't want anyone else to go through the nightmare we had and will do whatever we can to make sure this company and its owner are unable to maintain or acquire any new licenses (he's had more than one company name and license already!). Evidence to support our case to the Court included phone logs, phone bills confirming dates of phone conversations, the BBB complaint/response from contractor/and ultimate BBB response, copy of our complaint to the NM Attorney General's Office and the response from the vendor, etc. Despite what the business has reflected on the various websites, they are not rated "A" by the BBB and are not even accredited. We filed a complaint with the BBB and they were unable to resolve our issues with CTNS (due to lack of cooperation by the vendor). We can only wish we were aware of all the previous judgments issued to vendors and former clients prior to signing our contract. Our recommendation is that any potential clients do not even bother to visit the showroom. Do not be fooled by what appear to be good prices. Turn and run!
