TOWER WINDOWS & DOORS INC

I ordered 9 custom windows based on architectural plans.  The plans specified Anderson windows with a specific model number which included sizing.  My contractor recommended changing the window brand to Weathershield because he felt they matched the house better.   They were slightly more expensive but I agreed.  I told both the contractor and the sales man that I would like to review the order for accuracy before it was placed.  No one showed me the order. 
The custom windows arrived on time four weeks later.  I measured the windows and discovered that they were not the correct size.  The windows actually measured 4.5 inches longer than the architect specified.  When I brought this to the attention of my contractor he was unaware of the size change.  The sales man came out to the house and explained that the Weathershield windows were not available in the size that we had specified.  So without explaining this to either myself or my contractor - he went ahead and placed the order for larger windows rather than smaller.  He claimed that he didn't know the windows were going above the counters and never looked at my $12,000 worth of plans.  He refused to take responsibility for this by saying that the contractor signed off on the order so it was his fault.
My contractor acknowledged his responsibility and was prepared to order all new windows.  I declined his offer because I didn't want to wait four more weeks and see 9 windows go to waste because of course they are NOT returnable.  The entire design of my kitchen had to be altered to accommodate these windows.
