"Your member's request is unreasonable & doesn't comply with the inspection agreement signed by your member. The terms of the written agreement provided arbitration as the only form of dispute resolution. Your member's attorney has a copy of this agreement. No home inspection allows for intrusion into walls & ceilings. A leaking drain pipe is concealed within the walls. The circumstances leading up to this pipe leaking haven't been determined. Was this drain cleared with a power auger? or caustic chemicals? There was no evidence of water infiltration into the basement during the inspection. An inspection is a snap shot at a given point in time. Had the owner covered up any evidence of past water infiltration? Had the exterior grade been changed since the buyers took possession? Have the gutters been maintained? Has the sump pump been maintained? Did the pump fail like so many did during April heavy rains? A large percentage of NJ residents had water in basements during April storms. Many communities were under water. Many sump pumps failed to keep pace with water infiltration. An assessment must take place to determine what changes took place to cause water infiltration. Has the seller been made aware of this problem? Did the seller disclose information regarding water infiltration? Every pipe will eventually deteriorate & fail. Given enough rain every basement will take on water."
