We hire Magaletta design to create a 3D design of our yard including a pool, outdoor kitchen, patio and fire place and paid them $2,200 on March 23rd. We met Matthew Magaletta twice between March and August, he did not take pictures or measurements at either meeting. At both meetings he just stated that the pool would be installed in the left side of the yard. On both occasions we told him that the town would not allow the pool in that spot due to the set backs.
On July 27th Magaletta submitted the pool specs from the pool manufacturer and a penciled in pool on an old survey to the town engineer. We did not see or sign-off on these items prior to submission. The town engineer rejected the so called plans stating that Magaletta did not follow the town codes, specifications or set-backs.
After the "plan" was rejected we told Matthew Magaletta we would not use his services to build the outdoor kitchen & pool or anything else for that matter and we wanted a full refund. We had several follow-up conversations with Matthew in which he promised us everything from a full refund to a completed 3D design using the correct setbacks.
To date we have not received our 3D landscape design or any portion of our $2,200. We have recently filed a claim in small claims court to resolve the matter.
