This is the last set if emails from me and his
partner, Colleen,
never completed anything and when asked colleen
said this is not the work rather the warrantee. But the work was never done.
I wrote:
you are now claiming that this is warranty
work.Warranty work applies when something was done correctly and then does not
function or it breaks. This work was never done correctly in the first, second,
or third place.This job is NOT completed
 
The landing is still collecting water and
creating an ice hazard for us and for my clients. The sump pump piping was
installed improperly and it is interfering with the removal of the sump cover
to the extent that it is impossible to take it off and put it back on.The
piping is not aligned with the pump or with the cover.  
They claimed these were warranty issues even
though they never finished. They are issues in which the work done does not
measure up to the job specs. It is substandard work that is not aligned with
the Uniform Construction Code.No call or email between us has ever even hinted
that this job is or ever was completed. You repeatedly refer to the work that
still remains to be done in your emails. No one from your company has been here
since the beginning of January. Your emails about work still needing to be
completed are as recent as last week. Now you claim it is done and that this is
warranty work. By charging that final payment before job completion you are in
violation of contract law and of fair business practices. $4,100.00Then,
charging my card for the balance when the work is not done is a violation of
your own contract as well as a violation of my credit card because it was not
authorized by me.We had already paid you 85.4% whereas the contract you wrote
states that 25% is due ?upon completion? We should not have been charged more
than 75% according to your contract and here charged 85.4% and then on Jan
18th you made an unauthorized charge to my credit card for what would have
been due upon completion. But the job is in no way done.The charge you made to
my card of $1200.00 is illegal and unethical and I will take care to protect
myself from such practices and also to help others to not be subject to such
practices as well.That would not be necessary if you corrected this. But from
your email you are clearly not willing to do that at this time. I am hoping
that you will correct this so that I do not have to take any further action
myself.

got home there was a puddle that remained on the front landing for two days. I
know Shawn said it is supposed to be built so that the water rolls off of the
landing.You still have not responded to the fact that I did not authorize the
charge you put on my card on Jan 18th. You had asked me about payment and I
told you NOT to use the card until all of the work is satisfactorily done.
Then, Dr. Klein told you that when the work is all completed to please charge
his card instead of mine. I have asked and written about this several times.
You still have not corrected that even though the work is not finished. Re
your comment on the insulation, Dr Klein asked Shawn to insulate the crawl
spaces the day the men started working. Shawn cancelled the sidewalks because
the town would not permit it during this time of year. We did not know that
people do not do sidewalks in cold weather. Shawn said he would deduct that
from the bill. We did not find out that he did not get the permit for it until
more than a week after they began working. The sidewalk has nothing to do with
the insulation.Regarding the dirt left on the basement floor, Shawn told Dr.
Klein that the painter will repaint it anyway and that is the best he could do.
My husband felt pressured and at the time did not know that no painter will
touch that floor because it was so filthy with earth. Because of that it is
still not painted. There were still clumps of earth and the rest was just
covered with a thick film. I am sorry you had to do this in your socks. I
suggest getting a service who does this kind of cleaning. It was so soiled that
it needed a professional and not a business owner in socks to do the job. I am
having that done by a service who does that because no painter will touch it
while it is so full of earth. You write : ? If we were left to do our
job, we may have had a very different result. ?Had  just let you ?do
your job? without his input, we would still have a crooked lopsided sidewalk,
newly, installed, broken steps. When you came and supervised after it had been
done that way, you said that had it been repaired the way Shawn wanted, it
would have been a patch job. It was careless to put in a broken step in the
first place. Why didn?t they check it before installing?Had you or the men been
left to do the job, as you write, we would also still have crooked, leaky sump
pump pipes , a mismatched unaesthetic, uneven, lopsided, concrete walkway that
we would not have been able to live with.There would still be dangerous pits in
the ground endangering people entering and leaving. The backyard would still
look like the junkyard that the men turned it into. There were piles of dirt
left in the front walkway for days without Shawn responding to any of my calls
during that time to get him to make it safe for me and my clients to enter and
leave the premises. The fact that I use crutches to walk as do many of my
clients, makes it even more of a hazard. Even Mike, the plumber, began cleaning
up some of the strewn rocks, pipes, tools and food containers that your men
left in front of the house as well as the mud and dirt all over the place. I
know that we showed you pictures of that mess. These errors were acknowledged
by Shawn but quickly set aside as nothing.Also acknowledged at the time, was
that the men breaking ground and drilling in the basement did not put tape on
the doorway to prevent the dirt and dust from traveling throughout the whole
house all day long. You and Shawn both said that they should have known better
than to not take that precaution. But it seems to not matter once admitted, as
if that erases it.There was also a large area of water in the basement after
the work was said to be done that could have caused more life threatening mold
conditions had it not been corrected. We were perhaps fortunate that we got
water in the basement at that time.  That made it clear that more
work was needed to make the water drain into the French drain, rather than
remaining in the basement.Rough chipped, unfinished stone walls, unpainted and
unpaintable all around the basement at the bottom outer edge of the French
drains would have been left that way had Dr Klein left you to ?do your
work?.Pipes coming out of the sump pump were sticking out in the middle of the
floor, two feet away from the wall and others one foot away from the side of
the house in the back yard, both creating a hazard for people to trip over
while also taking away useable space. What if there were snow covering it?
People would trip over the pipes and fall. Why would they put pipes so far from
the wall? The men could not have been thinking.Dr Klein tried to speak with
Julio, your worker, as he was doing the work in an unacceptable manner, but
Julio said he did not understand English. The w

I live in a street where we have two retaining walls. We had to replace both of them. I used S. Mays Construction, LLC, who I found on Angie's List. They did a very very good job. They did it in a very short time, and the owner, Shaun, was very professional. He was very nice and all the people who worked for him did a terrific job. They finished the whole thing in 10 days. The system of interlocking blocks is new and much better looking. I was able to choose from several colors and I chose light brown.
