Hernandez contractor Santos originally arrived with 1/4 inch chip wood instead plywood per contract he knew require 1/2 inch to match the existing part of the roof. Santos had original a couple days before received $450 per check for roof material well in excess to cover about 4 additional plywood to repair the roof area of about 14 by 18 feet and wanting cash to buy the wood. One plywood 4 by 8 feet was included per contract and for each additional per contract for $50 including installation. When he needed 2 more sheets 4 by 8 foot, again he want to get cash again. Every time when he wanted additional cash for the plywood he called Hernandez to get the money. After starting cutting the roof along the rafters he advised me needing two more sheets of plywood only this time he wanted $150 for those in contradiction of the contract $100 for two sheets claiming he has to buy gasoline apparently driving for and back to Hernandez to get cash to purchased it from Home Depot and that he had to pay his helper. All this he knew before he issued the contract. That plywood was not installed because I rejected the increase of the price. I begged him instead to install from left over plywood at a couple places the existing wood showed surface damage. After Santos finished the job, and inspection within the crawl space showed that at several places between the newly installed wood sand the existing wood were gabs of at least 1/2 inch. Furthermore an inspection revealed that what Santos called ice and water shield was only tar paper without adhesive to glue to the plywood of the roof. Hernandez and Santos insisted having installed ice and water shield also denied having caused property damage breaking with their feet through the sheet rock ceiling of the rooms below. Falsely claiming their installation included Ice and water shield constitutes in fraud. The roof has to be redone because ice and water shield cannot be inserted afterwards. I needed to stop my final $550 check for labor because the job has to be redone and when redoing the roof the installed shingles and tar paper being destroyed by removal and cannot be reused again. The case requires a fraud charge against Cowboy Construction as long I do not receive my $450 I paid for the material.
