The promised equipment was never on site. Two days after the work was completed the driveway started caving into the ditch. It was caving in in sections about 2 feet deep across the 70 foot section they had repaired. We waited a week for him to come and when we called him he said he saw no issues. The cave ins were very, very apparent. He told him to come and look at the problem. He said he would fix it. Then he told me it would be $2000 to fix this. I couldn’t believe this. He then said it would be $800. I told him he wasn’t getting a penny more because he was supposed to have fixed it in the first place. When I received the bill it was $4034.29. When I confronted him about this he said he did additional work up by my barn. He was never supposed to do work up by my barn. He said they dumped three tri-axle loads of material which was never to be found. There was no evidence of this material. I had initially walked the driveway with him and specifically told them where the work was to be done on the driveway and we specifically agreed upon it. Later we had other companies to come out and fix our driveway. They told us if the proper material had been laid and the excavator had been there we wouldn’t be having these problems.
