Termite's Lawnscaping

Made initial contact with company on March 7, 2012 via email. Set up a date and time for someone to come to my home and give an estimate for some landscaping, March 13, 2012 was the date, well turned out to be a no show. No call or email. On March 21, 2012, I finally hear back from them via email says, he must have forgotten, Holden Steinman is his name. On March 23, 2012, Holden does stop by surveys my yard takes a few measurements and we discuss the work that needs to be done. He says he will have an estimate for me next week. On March 26, 2012, I get his estimate of $1000, I ask "when can you start and how long will it take?" I am told they will start April 9, 2012 and the job will take about 5 days. I am overlooking his previous untimeliness/punctuality issues. I am ask to render an upfront payment of $450 cash, this is well beyond the 20-30% most contractor's require and there's no written contract at this point. I inform Holden that I require a contract and I am definitely am not comfortable with a cash transaction. So he says he will have the contract drawn up. On April 6, 2012, Holden stops by with the contract it's nothing fancy and fairly basic not anything that would have taken 11 days to draft that's for sure. We sign the contract and and I give Holden a money order for the $450, against my better judgement but I press on. At some point on Saturday, April 7, 2012. I was sent an email however I didn't receive the email on my Blackberry until just before 10 pm. Basically, I am being told that his supplier had sold out of the type of rock I had selected for mulch and that an additional $1200 was now required. I inform Holden that I don't really see that as my problem, we have a contract and he should have checked the availability and cost of the required materials before signing the contract. Holden actually asks me to meet him in the Big Lot's parking lot at 10:30 pm on Easter weekend for a partial refund, both which I declined. We go back and forth, I am seriously considering just going to small claims court for breach of contract at this point. The partial refund is because he incurred a $12 check cashing fee because he did not make it to his bank on time Friday and he purchased some grass seed for the yard. I am intrigued as to what business passes those costs on to the customer, I didn't deduct the $0.75 cost of the money order from the deposit he required. Just so I could stop dealing with this so called company I decide to write off the $12 as an estimate fee. So long as they returned my deposit to me on Monday, April 9th, 2012, inwhich he did.
