We purchased a house in 2013 built by David Creech in 2005. The issue involves the construction of the granite hearth slab which was glued to, and is directly supported by, the wood subfloor. The issue was discovered on December 25, 2013 when, while burning a fire in the wood-burinig fireplace, a toxic smelling smoke filled the main floor of the house. The fire department was called and when they arrived they examined the supporting structure of the hearth. They diagnosed the issue as combustion of the construction adhesive between the hearth slab and the supporting wood subfloor (and possible combustion of the subfloor itself), and indicated that the construction of the hearth was not in compliance with the building code (hearth and hearth extension residential construction code R1003.9). Further, they advised burning wood or igniting gas logs in the fireplace was unsafe until the hearth was rebuilt in compliance with the construction code. I contacted the builder to make him aware of the problem and to ask for his help. We met and discussed the problem and David told me to contact him again after I had up with a gameplan to repair the issue. I recieved quotes from a number of vendors and e-mailed David a proposal asking him to consider roughly splitting the cost of the repair (his share would have been about $1,700). In response, David's attorney contacted me to tell me David would not pay.
