Mr Amero constantly mentioned that he had no funds and his home was soon to enter into foreclosure due to non payment of both mortgage and taxes. Because of the fact that the customer's new home is not destined to be completed as planned, the customer requested that John Amero repay the design fee and the deposit which had been paid to him (total $3200). The customer requesting the refund made it clear that a reasonable plan for repayment of fees would be acceptable. Mr Amero's response was the the customer should simply try to sell some of her personal items if she needed money. He also offered to complete the staircase and deliver it to her property (currently a one story home that has no need for a staircase!) and she could sell it herself to try to recoup her losses. This is a completely unacceptable response! Mr Amero's lack of willingness to negotiate a plan for repayment has required the customer to file in small claims court to ask that a judge order the repayment of fees given to John Amero Metal for work that was never performed. Throughout the time that Mr Amero came to work on the customer's property the two did become friendly and often participated in community activities together (movies, meals, conventions, etc). When Mr Amero became too forward in his quest for affection, the customer turned him down. However, the personal relationship (or lack thereof) has no bearing on the fact that Mr Amero was advanced funds for work that was never performed and is required by law to return said funds.
Description of Work: The services being reported here were never performed. However, this was through no fault of John Amero Metal. John Amero had been commissioned to fabricate a winding metal staircase in a new home that was being planned. A contract was signed and fees paid for design ($500) plus a 50% deposit ($2700) for the fabrication of the stairway. The contract did not state the these fees were nonrefundable. Unfortunately, financing for the home was denied from all loan companies despite the fact that applications were submitted to at least 7 different institutions. Given that the new home will not be built, Mr Amero was not required to design the staircase nor fabricate it as he had been paid to do. Throughout this time, Mr Amero did complete a number of other tasks for the customer and payment for these services were paid in full. The work that was completed was largely satisfactory and the customer has no complaints regarding them.
