Critterion helped us to make the difficult decision to not purchase this home since the structural flaw was serious in nature. For his work on my residence, the North Carolina Board of Examiners for Engineers found that Jeffery M. Simpson, PE "failed to be completely objective and truthful in professional reports and statements [.701(d)(1)] by reporting on areas not observed (May 14, 2010 report); failed to properly certify documents [.1103 (a)(5), b(5)] (May 14, 2010 report and June 14, 2010 report and plans); and affixed his seal to work not done under his direct supervisory control or responsible charge [.701(c)(3)] (June 14, 2010 report) by copying the work of another PE."  The Board issued Jeffery M. Simpson, PE a reprimand and levied a penalty of $1,000.

-By Consent Agreement 1/13/12:  Letter of Reprimand for providing a written evaluation of two or more systems constituting a home inspection for compensation without having a current (active) home inspection license and having an improper contract for a home inspection.  Upon reinstatement of his license on active status 10 days Suspension; 6 months Probation; 4 additional hrs of education related to report writing; submit 1 report and contract for review.

On January 26th, 2010, I signed a contract with Criterium-Simpson Engineers, Inc.  The contract states, ?The services to be provided are as follows:  Perform site visits to measure home top to bottom in order to produce basic foundation and framing plans to further evaluate the loads.  This information will be used to produce a plan of repair scope of work report to correct structural deficiencies. Produce a plan of repair scope of work report to correct the structural deficiencies of the home.?  The terms were: ?Client will pay at an hourly rate of $165.00 per hour not to exceed $6,000.00.  A $2,000.00 retainer is due before the time of the site inspections.?  I received a draft of a repair plan that did not fix all the problems with my house and would have left it with numerous building code violations.  I received a draft of an inspection report plagiarized from the report of the engineer from Whitley Engineering who did the first inspection of my house. Criterium-Simpson attempted to pass this work on to me as their own.  In the meantime, the company exceeded the not to exceed limit of $6,000 and billed me for $7,218.75.  As of June 15, 2010, I still had no final report and repair plan to provide to the builder I was suing and was going to miss the legal deadline to do so.  I had to terminate the services of Criterium-Simpson and seek a new engineer.  I requested my $4,578.75 back, but it was not returned.  An engineer from Howard Verna Engineering then provided me in 17 days what Criterium-Simpson failed to produce in five months.
