"This guy John is not telling the truth. We did this job 4 years ago and he was so happy. He tried to sue me and lied and lost. I have him on video claiming how much he and his wife loved it. The next day he said his did not like the color. I offered to redo it for nothing. But he went crazy and said he wanted his money back. We were planned to come back and rework the area, but he called on a Friday night 2 days before the work was scheduled and said he was tame to court. "The rain had held us up several days and when we?re to come back, we called to tell them we were on our way to remove the forms he said they had removed the forms and they did not need us to come out. They wanted us to add an addition to the patio that was installed perfect and they loved it. I did not have time to do the additional work due to work schedule. "We only signed one contract in November and no monies were exchanged until Dec 31 to lock in material cost. We do not schedule work until we get a deposit. We explained to the customer we were still working on a job that the weather had set us back a lot (Dec, Jan, Feb and parts of March were severe and not favorable for digging). When we started the job for the original work the customer added an additional wall in the back and we had to regrade the back area and divert a small creek to keep the back yard from washing out and standing in water. In the process of all of this, rain was a factor because rain was prevalent every week 2 to 3 to 4 days at a time. Yes, there were dry days but the ground was still saturated and too muddy to maneuver a machine in a saturated mud area. Out of a month we able to work 6 to 7 days at most and that was on the back area that was added. We finally were able to start the original work and of course the rain was still prevalent and severe, again 3 days of rain and 2 days dry maybe. The days that were dry we were trying to let things dry out so we would not be a total mess and would cost more to fix and clean up. There was addition to the original work as well. We gave the customer a $1000.00 discount because of the setbacks in regards to all of the rain and weather, we stayed in constant communication with the customer at all times. We gave the customer a flat cost with no profit on some items such as plants, grading labor, etc. We were paid in full."
