A portion of the overall project was completed with some integrity. The remaining portions (70%) will require de-struction and re-erection to complete the wall and render it safe as well as to meet the terms spelled out in the initial contract completed by Mr. Warren. Other parts of the contract which were neglected and ignored by Mr. Warren will also have to be completed by some other contractor who will have to be hired to come in with excavating equipment to take apart and re-assemble the structurally unsound part of the wall and complete the phases that were to be completed as the wall was being built. The referenced Lawsuit required me as well as my wife to attend court on three different occasions. The outcome in both of the proceedings in two different courts was a dismissal of the suit brought against me by Mr. Warren by the two judges presiding in this matter.
Description of Work: Mr. Warren responded to a call from me concerning the removal of an existing wall and the construction of a new rock (bolder type) wall to replace the existing wall. The construction details were agreed upon and eventually spelled out in a written contract completed by Mr. Warren. The construction cost was also spelled out in the contract as were the various responsibilities of Mr. Warren and his company to complete the job as well as my responsibility (terms of payment) when the work was completed. After signing the contract I was immediately asked by Mr. Warren for a "draw" on the agreed upon price. I wrote Mr. Warren a check for 1/3 of the overall price so that he (as he put it) would have some working money to start the job. Mr. Warren and his helper, completed one portion of the wall in a satisfactory manner. The other portion of the wall was comprised of shoddy construction and not of the standard spelled out in the contract. When Mr. Warren was confronted about this less than "Workmanlike Manner" of construction as well as the various items in the contract that had been ignored and or neglected, Mr. Warren left the site and never returned. Immediately prior to his leaving the site I informed Mr. Warren that no more dispersements would take place until he corrected the deficiencies in his construction and the items spelled out in the contract were completed. Up until this point I had dispersed some $7,000.00 of the overall $10,000.00 agreed upon price and felt that this was more than enough to show my intent to honor the contract and only asked that Mr. Warren do the same. The next notification that I had concerning this contract or work completion was when a Deputy Sheriff arrived at my home some week or so later and I was served with a lawsuit claiming that I had refused to pay Mr. Warren for his work.
