Jamie Schwarz is the contractor I hired to build my home in Livingston, Montana. He hired subcontractors who began excavation for the basement in early February 2007 when the ground was snow covered. He did not take any soil samples to test for clay – which a GEO-Engineer I hired this year determined is mixed in the soil. From the first year I moved into the house, I noticed cracks in the basement floor and ceiling. Jamie said they were from settling and unsatisfactorily repaired the crack in the vaulted ceiling. However, during the next two years (2008 and 2009) the settling became sinking, and now many cracks have appeared in all rooms of the house. I am semi-retired and this house is my retirement home. Jamie saw all the damage and agreed the house is sinking but refuses to contribute financially to shoring up the foundation with helical piers – a very expensive undertaking that is needed – according to two engineers (GEO and Structural) I hired – before the frame of the house becomes damaged. I have hired a law firm to seek financial assistance from Schwarz who so far has refused.
