Description of Work: We purchased a home from L&R Construction on June 14, 2007. Due to inadequate drainage on the West side of our property, water would pool for greater then 24 hours at a time. This is a defect covered in Section IIA of the Warranty Coverage provided by our builder. “It states that standing water shall not be present 24 hours after a rainfall, except that in swales which drain areas where a sump pump discharges.” My wife and I requested that the drainage be corrected to eliminate the problem with standing water after even minimal rainfalls. L & R construction was unwilling to remedy this situation. Therefore, they were in breach of the warranty they provided us. We expected that they would honor their promise to rectify a serious problem with our drainage. My wife and I would not have purchased this home if we thought they would not honor their home warranty. Consequently, in order to prevent the possibility of a wet basement due to improper drainage and to allow us full use of our entire yard we contacted a landscaper whom our realtor recommended to install a French drain. This alleviated the problem, but cost us $1350.00 in labor and materials. We requested that the builder honor the terms of our home warranty and reimburse us for these costs to correct the defect in the drainage.
