Due to the wet and rainy weather, there was delay in completing the work. When a dry day finally arrived, he appeared at my door and said they want to pour, but asked that I call the concrete supplier to put the cost for concrete on my charge card, otherwise there would be further delays. I consented because I was anxious to get the job done. Making this additional payment towards the original estimate left only 15% balance due. Despite clear indications of rain and one of the rainiest springs in recent memory, he failed to cover freshly-poured concrete. As a result, the new driveway suffered pitting and scaling, chipping, crumbling. He recognized the faults and indicated the work may need to be redone. But he wanted to try a patching and recoat solution first, with promises of extended warranty and free seal coats for 6 years. He patched several areas with exposed aggregate and applied Mirocote MPC on the patched areas and a dozen other areas with severe degradation. He started the patch/recoat process in early May, but he never came back. The areas that were patched eventually suffered severe deterioration in color, during an unsightly brown. The areas coated with Mirocote MPC were a different shade of grey color than the poured concrete. During the summer, pock marks (pitting) got worse on practically the entire driveway. Bottom line, I had an ugly driveway. I contacted Paul Klinefelter 7 times by phone and letter. I mailed letters because I wanted him to see how the driveway was progressively getting worse in appearance. My letters showed pictures of the driveway and asked him to return to finish the work. The first letter mailed to him was returned, with the post office saying the forwarding time was expired. So, his address on the contract was invalid and he failed to provide an address where he could be reached. Luckily, the post office provided the forwarding address location in Fridley, MN. On a subsequent phone call to him, Paul Klinefelter acknowledged receipt of my letters. There were three arranged occasions where he promised to return to the job site (all 3 occasions were initiated by my call to him). On each occasion he failed to appear and offered no explanation or notice. He never called me. I gave him every opportunity to repair the defective work, and he took advantage of my patience and trust. His pattern of misleading me again and again revealed that he had no intention of fulfilling the promises or living up to obligation under the contract. I consulted with several experts, all of whom agreed that the only solution is a total replacement of the driveway. I also became aware of obvious shortcuts taken by Paul Klinefelter, typical of work done by novices, not someone with his years of experience. Because Paul Klinefelter did numerous other jobs on my block, I became aware of his association with another provider. One of my neighbors overpaid him, and Paul wrote a check from a bank account with the name of Distinctive Designs in Landscape and Concrete in Wyoming, MN. Incidentally, the check to my neighbor bounced and Paul Klinefelter promised on numerous occasions to stop over with cash, but he always failed to appear.
Description of Work: Removed 680 square feet of old concrete driveway and replaced with new concrete driveway. I paid 55% down on April 11. He removed old driveway on April 25. He poured new driveway on April 29.
