We purchased a Boost Mobile android 4g LTE cell phone. We get the phone home and it has absolutely no reception. We take the phone back to the store and were informed that the do not do returns you will need to send the phone back to the manufacturer. The clerk takes the phone and goes through all of the diagnostic screens and states "well you have a bad phone".  The clerk states that the owner "does not like to do returns and that he is not a very nice person".  We respond with that is OK someone will be getting us a phone that works so she could call him in and we would be glad to talk to him.  The reply was for a 35.00 dollar restocking fee they could probably exchange our phone for a new one. This is a brand new out of the box cell phone that we just purchased the day before. We inform the clerk that we will not pay a restocking fee for a defective phone that was just purchased the day before. After arguing for 35 minutes I finally leave the store with the defective phone.
 I contact Boost Mobile customer care and they went through all of the diagnostic systems and we were informed that we had a "bad phone". I tell the customer care representative that the store where the phone was purchased told us that they do not do returns and we would have to send the phone back to the manufacturer. I was instructed that the first thirty days the retailer is responsible for the replacement of the defective merchandise and then the manufacturer for the remainder of the warranty period. I was instructed by the customer care representative to return to the retailer and call the customer care number and to give the phone to the clerk if they still refuse to exchange the phone. 
We return to the store and again were informed that we "had a bad phone" so I contact customer care and give the phone to the clerk. The clerk goes through all of the diagnostic stuff with the customer care representative and then informs us that they could do an exchange but there was now a 15.00 fee because "it costs us money to return the phone". I was outraged that I had purchased a "brand new" cell phone and was being charged a fee to exchange it for a working device. I ended up paying the 15.00 (this is my business phone) and got a new phone that we made sure worked before we left the store.  I can not believe that I had to pay a restocking fee for merchandise that was defective.
