Kitchen and Bathroom Remodel

In March 2007 I hired Tim to develop plans to remodel my home and garage. In December 2007 we finalized plans and in January 2008, I started writing checks to begin the kitchen/half bath remodel. I was assured the project would be done by Thanksgiving. I did most of the demo work myself. They finally began working in April. In the beginning, Tim and his son Jeff (Jeff is the laborer) would show up regularly and get work done. After about 3 months, Jeff would show up 2-3 days/week. Then, Jeff would show up for a few hours 1-2 days/week - one/two weeks of the month. By October, work practically came to a halt. In February 2009, my kitchen sink was finally installed. It's now May 2009 and the project is still not complete. The two major pieces of the project still incomplete are 1) a sub zero refrigerator I paid for in Jan 2008 and 2) a custom mosaic tile floor border which is about a foot in from the wall (product and installation paid for in Nov '08 - the rest of the floor is installed, but the border is not, so i have a 4-inch wide sharp tile edged gap around my island). The products have not been installed because he does not have the funds to purchase the fridge or the tile. Where was my money spent?? The framing around one of the doors is not complete because the fridge needs to be installed first. Also - the entry way of my kitchen is only framed in on the kitchen side - the dining room side is not "part of the project and is an additional charge". I was just informed of this in February! So on the dining room side of the arch, I'm looking at the gap between the drywall and wood. Throughout the kitchen, which is medium stained cherry, you see several nail holes that have not been filled in yet. I was told months ago it'd be done. I had to constantly complain for months to get the +40 popping drywall screws repaired. Jeff came and patched them, but never returned to sand and paint - so I did that myself. On several occassions, I was told Jeff would be here to work but he would not show up. Additionally, during the plan development phase, I paid for a land survey and for variance approval for my garage plans. I am still waiting for a copy of the land survey and proof that the variance was approved by the city.
