Billiard Table Sales
1. Steve Marks/Breaktime Billiards entered into a consignment agreement regarding a pool table on 5/14/12. Steve Marks/Breaktime Billiards took the pool table. The agreement was: a. Sell table for $1,500 less $350 delivery fee and b. If cannot sell, then return pool table for $350 fee
2. Periodically checked on status ? vague information
3. Steve indicated in late 2012/early 2013 that he had a deposit on the table and the buyer would purchase the pool table when the buyer received his tax refund
4. May 8, 2013 called Steve Marks/Breaktime Billiards asking about the status of the pool table. Steve Marks/Breaktime Billiards said he did not remember the transaction. On May 8, 2013 then sent Steve Marks/Breaktime Billiards a copy of the consignment agreement.
5. May 21, 2013, forwarded the May 8, 2013 email adding, ?If I do not hear from you soon, I will be contacting my lawyer.?
6. May 22, 2013 Steve Marks/Breaktime Billiards replied ?If thats what you want to do then get in line ! And it's a very long one !?
7. May 30, 2013, Powers, Chapman Attorneys sent Steve Marks/Breaktime Billiards a letter asking Steve Marks/Breaktime Billiards to fulfill the contract.
8. As of June 24, 2013 no reply from Steve Marks/Breaktime Billiards.
