We are currently in the process of contacting the main company and potentially filing a complaint with the state licensing agency, and/or filing a small claims suit. The reason being: this home was purchased because the repairs were minor in comparison to the price we were getting the house for. These repairs that were NOT listed on the report add at least another 12-15K, if not more. We are in the process of getting estimates. If we had known of these issues, we could have put a lower bid in on the home or asked the homeowner to correct these issues before we purchased the house. These are not minor repairs, nor are they things that weren't obvious. In the case of the deck, the report was completely false. We completely understand that a home inspection is not going to find, nor is the home inspector obligated to report, every single minor thing wrong with the home. However, these are MAJOR areas of concern and should have been reported so that we could have been prepared with a different offer on the home.
Description of Work: My mother purchased this home for 10K less than what the seller was asking. The seller refused to make any of the repairs that HomeTeam listed on their report, which was fine because the repairs were relatively minor and we were already getting the house for less than asking price. I am living in this house, as well, and will be buying it from her in a couple of years, so I have a vested interest in the condition of the home. Upon moving in to the home, we found numerous, obvious issues that were not listed on the report. The dining room window frame comes out when the window is opened, which poses a safety hazard. One of the bedroom windows has a 2 inch gap between the window and the frame. The previous owners simply stuffed yellow insulation in the gap, but if the window is opened, the insulation needs to be re-packed. The basement stairs are separating from the railing, and don't have risers or supports, and are at least 3-4 inches longer than steps built to code, therefore the center warps down when weight is applied to them. The movers wouldn't even use the stairs when moving us in due to safety concerns. This is a finished basement, with two additional bedrooms, and will be used as a living space, so these stairs will be used frequently. Regarding the back deck, while the report indicated "some of the wood deck boards had "significant deterioration", it did not indicate that virtually every single board on the deck was actually detiorated. The railings are separating from the deck as well. The entire deck needs replaced, not just some of the boards. It also states "there were no major visual defects observed on the visible portion of the deck or support structure", which is a blatant untruth. All one has to do is come off the deck and look at the support structure underneath to see the rotting wood, so damaged in some places that the wood isn't even attached to the deck any more. This deck is not aesthetic. It's a functional deck, with a sliding glass door from both the kitchen and the living room, both which are on the 2nd story above the walk-out basement.
