The agent demanded us to provide documents not necessary for purchase such as our tax records and the purchase agreement on the house we were selling. We had given a pre approval letter and $1000 ernest money down and we were still required to jump thru this realty companies hoops.
The inspections were not done and the agent told us that the house we were buying would not be available at close which is a contractal date on the purchase agreement.
"The Tomie Raines, Inc. agents in this transaction were very experienced professionals and represented the seller and the seller's wishes. The buyer was represented by a very inexperienced agent from another firm so we cannot attest to the accuracy or quality of the advise these folks received or how our actions were communicated. We had to communicate directly with the supervising broker to get what we needed for the sale.. The well and septic inspections were ordered after the property inspection was complete (6/25) and the appraisal was in. The seller did not want to have the well and septic inspections done and the septic pumped till she was sure the sale price was accepted by the lender. This was a competing offer situation with a back up offer. The seller was not in an "I have to move" situation. The inspectors were behind at that time of year as it was peak selling time. They did the inspection and lost the water sample at the lab, so a new sample had to be drawn. It set it back 3 days. We did however have conformance by July 26, 2013. We had conformance in plenty of time for the close, on the contract by August 1, 2013. Obtaining the purchase agreement from the pending sale on the buyers home is standard procedure in a domino chain of sales. We had asked for copies of the pre-approval on their buyer, the purchase agreement, and proof of deposit. There was no request for any "tax records" by us, nor would there be a reason to ask for them. It was all on the counter offer which was agreed to by all parties. The seller was an older lady moving out of the area and we needed to negotiate the time for her to be able to move and clean up after the move. The date on the contract worked for her. The house was left broom clean and was never "filthy" at any time during the listing. We did not see it before the close but the buyers had the opportunity for their walk through prior to the close and everything was cordial at the closing, and the buyers and sellers chatted about the perennials, the neighbors, etc. There was no indication of any issues. Occupancy was at close. Closing was 7/31 and never needed to be extended. Tomie Raines, Inc. surveys all of our clients after closing which is done by an independent research company. We are sorry these buyers had such a bad experience but that was not caused by the actions of our agents who owed a fiduciary responsibility to the seller."
