The next day, we come home from grocery shopping to find a work crew at our home! They had our old gutters pulled down and new gutters going up! We immediately stopped them and asked them who they were and what they were doing. The crew said that Mike from Mike's Windows had called them that morning and told them to come do our gutters!! We had NOT given him the job, had not authorized any work and were completey shocked! The crew was shocked as well. They said they would stop and started gathering their stuff. I told them they had placed us in an impossible position because now our gutters were on the ground and theirs were half up. We immediately attempted to contact Mike at Mike's Windows. We spoke to his office personnel who stated Mike was not there. She confirmed that Mike had told her that we would notify her at the end of the week if they got the job and that the crew would not even be sent until the following week if we called and gave the job to them. She asked to speak to the foreman, the phone was on speaker the whole time. She could not find our file.
We told her we were placed in an impossible position since our house was now comprimised and either we make them stop when our gutters were on the ground or allow them to complete it since there was a storm coming. Either way they did not have our approval in the first place. Since we had known Mike for awhile and since we were placed in this terrible predictament, we informed his staff that we would allow completion ONLY if there was a discount on the job since it was not authorized. We told the office staff to have Mike call us immediately if this was not acceptable.
We never heard from Mike, although we learned he had called the foreman later instead of us. The crew there kept apologizing to us and even stated that this type of thing had happened with Mike before. We as well had had a previous situation with him but gave him the benefit of the doubt then. Once could be a simple error, but finding out it has happened other times appears to be a pattern.
The work was completed, although not to our satisfaction. With the first rain it was noted that the crew had not cleared the drainage pipe prior to hooking up the downspout. They also had not attached that downspout properly, resulting in leaking with every rain which causes flooding adjacent to our foundation!
Then we get an unitemized bill from Mike's Windows in the mail. No call, no apology, and no discount. To make an already long story short, after a couple letters reminding Mike that he was never contracted to do this work, sent a crew without authorization as well as being informed that the only way they could complete it was with a discount.....Mike refused to give the discount, and left us a very nasty voicemail demanding payment in full. We sent him a good faith payment along with a letter stating we would get our third and final quote, if his price was in fact the lowest we would then pay his amount but if the third quote was lower we would pay the lower amount. Mr. Panek responded with another nasty voicemail stating he was going to the local court and filing a small claims suit and a Lien on our home if we didn't pay it.
It's concerning that any contractor thinks they have a right to just do anything on a person's home just because you asked for a quote.....then think he has some legal right to demand payment or try to put a lien on home when he was not authorized to do any work in the first place.
Again, in one letter we sent we proposed a very fair way to resolve the matter, stating our intention to get that third and final quote. That if he had in fact given us the best rate, we would send the amount of his bill in full (and we send a good faith payment of 25 percent). He acknowledged receipt of that letter and payment via voicemail then said he was taking us to court. One would think that if he in fact KNEW that we would not be able to beat his rate.....he would have no issue with it. Afterall we had every legal right to not pay him anything! We also requested an itemized bill from him on three occasions and he refused to give us one. Instead he responded with defensiveness and threats. What is sad is we have known Mike for many years and we had to go through this.
Note:
Mr. Panek left us a voicemail recently stating we could have the discount (after threatening us with the unwarranted court filing and lien and resulting in us filing complaints with agencies as part of our legal recourse). We sent him a check (although we could have paid nothing) and stated we required a paid in full receipt from him. He has cashed both check we sent him (the second one the day he got it), and it's been over a week now. We still have received no receipt. We would just like this terrible situation to be over....but now have to wait for him to send the agreed upon receipt.......
