I had bought a home here in maine and used residential mortgage services and there tittle company h&d tittle servies in late feb of 2013.. long story short they sold my mortgage to another bank which I knew would happen. just recently I got my monthly mortgage bill from the new bank and it states that my escrow was in the negative over 3000 dollars. and that my monthly payment has 2 options pay escrow in full and the payment will go up from 745.00 to 917.00 or make up the escrow in 12 months payments and the new payment will be 1200.00 per month. I am 78 years old and on a fixed income. as I started reading through my hud-1 forms they had written that the yearly property taxes were 1517.12 so they set up the escrow to take out 126.42 for taxes and 44 and change for home insurance. well come to find out the real property taxes are 3034.00 for the year, so I was going down a dead end road right from the start.. I called them and they blamed the assessor. residential mortgage wrote 1517.12 for the year and 2 payments of 758.00 was to be taken out in april and oct. so not only that the sellers got away with not paying there fair share of taxes from dec to feb they only paid 450.00 which is off a few hundred dollars. it clearly states on the hud-1 form that the figures have to be true otherwise according to tittle 18 us code 1001 section 1010 penilty fines and or imprisment can occur. so because they can read the tax papers that clearly state 2 payments of 1517.35 total 3034.00 +change that im responsible for there screw up,, our atty states different we will see them in court.

The member’s complaint related to her real estate property tax, which is outside the company’s control. RMS financed this person’s purchase of property that was being deeded out of a larger parcel. The property had not been separately assessed, and the borrower was advised that we could only estimate the taxes that ultimately would be assessed about 7 months after closing. We used an estimate provided by the independent appraiser and which appeared reasonable. Ultimately, the town assessed the property at a higher value, and at the same time increased the rate of tax (“mil rate”). These two factors combined to significantly increase the property tax on the property owner. While we understand that it is upsetting to face the higher assessment and increased tax rate; RMS had no control over the assessment by the Town or the mil rate set by the town. The property owner may have a basis to question the town’s assessment, which seems high given that only one-half of the original parcel was purchased. She may also want to explore the availability of Maine’s homestead exemption to reduce her future property tax burden.
