"First, the [Member Name] purchased a home from Monogram Building & Design, Inc. not Monogram Custom Homes. Kathy Clark is not a co-owner of Monogram Custom Homes, nor was she an owner of Monogram Building & Design, Inc. Second, they purchased their home by deed dated December 27, 2007, not 2008. We received a phone call from [Member Name] on April 21st, 2014 regarding her plumbing issue. As stated in her complaint she said that she had noticed the smell weeks ago and hired a contractor to go under the house, who did not find any issues. After noticing the smell again the weekend prior to April 21st, she stated that she reviewed the subcontractor list given to her at settlement in 2007, and called the plumber who did the original installation. She found their number was no longer operational. She stated she called another contractor and had the work fixed. She wanted to be reimbursed for her expenses. After reviewing their information I, Kathy Clark, called [Member Name] back. Our records do not reflect any earlier complaint regarding this issue. Our records show that the crawl space was inspected prior to settlement on their home, and [Member Name admitted that they had hired a home inspector prior to settling on their home in 2007, who also inspected the crawl space. No plumbing issues were found. I explained to [Member Name] that I had put a call into the previous owners of the plumbing contractor, who were still in the plumbing business with a different company. I told her if they would agree to come out and review her problems and determine if they would cover it under some kind of warranty, that was the best I could offer. I also suggested that she put a claim into her homeowner's insurance. She said she was not going to do that because her premiums would go up. The standard builder's warranty is one year material and workmanship, two years on plumbing, electrical and HVAC and five years structural. This complaint was not reported in any of those time frames. If it was a timely, covered, warranty item, our standard states the contractor is supposed to be given the opportunity to investigate and repair if covered; none of which the [Member Name] afforded us the opportunity to do. When [Member Name]asked if she had any estimates for the work being done, she stated no, that she had contractors there working. [Member Name] stated that she was going to tell everyone she could that we were unethical builders who had a moral obligation to fix her problems. I told her I was sorry she felt that way, but in all fairness to think that they had never been under their house or had reason to send a contractor under there in seven years of ownership, seemed unrealistic. Since then I was informed that [Member Name] called an attorney who had previously represented Monogram Building & Design, Inc. to suggest that he put pressure on us to reimburse her. It is unknown in the seven years what might have transpired under the [Member Name] home. When the [Member Name] purchased the home in 2007, they were afforded every opportunity to inspect the house and to make a complaint during the warranty period if warranted. Monogram Building & Design, Inc. the company that [Member Name] home warranty was with is no longer active in business."
