"This is a very unfortunate situation. As co-owner of the company, I have been a part of this job from start to finish, and I feel the need to address each of these points according to the facts. Our contract to build this addition was set back a few weeks by the health department, which required the Owner to replace his septic tank with a bigger one before they would issue a building permit. This would require a proposed site plan with topography and the locations of new and future drain fields, etc. At this point, normally a surveyor would need to be contracted by the Owner at his expense and delay (based on the surveyor's schedule and turn-around time). For sake of time and kindness, I personally drew up these plans free of charge as a courtesy to the customer and to keep the timeline moving. I received several complaints from the customer about the time it was taking to be approved, and this was entirely in the hands of the health department. It is always our goal to start and finish our contracts in a timely and professional manner. The initial large pile of dirt in his front yard came from the excavator that was hired by the Owner independent of my company to dig out the old septic tank and put in the new one. When the dirt was left behind by the septic service (there is a charge to remove it from the site), we made a decision to remove it at no extra charge. Regarding countertops, I prepared a budget for them, based on the individual price range, and I always go to the middle range of pricing, so the customer has flex either way. The customer's mother picked out a slab that was $800 over the budget that was allotted, a confusing experience for her admittedly as they opted to shop the store without me. My partner and I agreed to pay the extra cost out of our pocket so she could have the one she wanted. She was very grateful. As for the job sitting for any amount of time, from foundation being dug and work completed to punch list, was a span of about 5 months, which was well within our contracted completion timeline. It was an entire in-law suite with a brick front, full-bathroom, and full kitchen. As for the teak shower seat, it was not included in the job price, but rather it was a part of an allowance budget. The customer spent more than his total allowance even after the shower seat portion was credited back to his mother (a detailed reconciliation was presented at the end of the job). At the end of the job, my partner Wes and I both arranged to meet the Owner's mother at her new in-law suite, which she had put wonderful touches on since we had last been out. We walked through space and she told us how much she loved it (she even hugged us both). The substantial completion draw was due at that time, and so we asked her for it (as per contract) but to hold a little money back until we got a couple of small items taken care of (which is what we usually suggest). The Owner then demanded a refund for a water heater that was proposed mid-job and had never been installed. Our records show we gave a quote for the water heater, however, the homeowner did not have it installed by us. We never received any monies for the hot water heater, therefore they were not due a refund. Any attempt to open a dialog with this customer has been met with hostility.
