Metropolitan performed the work under the agreement and, most likely, absorbed the cost of some wood trim/siding replacement that went beyond the scope we agreed upon.
We hired Kevin to do a large painting job in our home prior to moving in. The work was not completed in the time frame outlined in the contract, however this was due to understandable delays due to the severe weather in our area. When we inspected the house after the job was complete, we noticed several problems - most notably, many of the English panels throughout the home and as well as an area of the basement were not painted as per our agreement. Kevin's explanation for not paining the English panels was that he only painted the ones in the rooms in which he was doing other painting. When it was pointed out to him that the contract states "all English panels not painted in semi gloss" he agreed to complete this portion of the job.
He refused, however, to complete the basement without us paying him more money. He gave several different excuses for why this part of the basement was not done: he initially said that the area was wallpaper, and removal of wallpaper in that area was not included in the contract. On further inspection, however, it was determined that this area was not wallpapered and was only painted. When this was pointed out to him, he then said he didn't paint the area (which was painted with a floral mural) because he "thought it looked nice" and thought we liked it, despite the fact that we had every other similarly-painted mural throughout the house repainted. From the start we requested that the entire basement be painted, and the contract states "Entire basement includes laundry room, bedroom in basement, storage room, main area, basement bathroom, staircase leading to basement, and all closets." His argument is that this area is not included in the "main area"; however, it is not a separate room and is in no way closed off from the rest of the basement. Furthermore, several similar open areas were painted as part of the "main area".
He then threatened to sue us, at which time we paid him the balance, however gave him 1 week to rectify the situation and complete the job prior to providing negative feedback about our experience to both Angie's list and our neighborhood HOA. In an apparent attempt to smooth things over, he thirdly blamed the delays for the room not being done, stating "as a businessman I'm sure you understand."
Several days after this discussion took place, we were notified that he would not be completing the work. Based on the contract, prior discussions regarding the work to be completed, and his changing explanations for why the area wasn't painted, we feel Kevin has been extremely dishonest and took advantage of us. He additionally tried to take advantage of us with respect to the English panels, which he only painted when pushed. We certainly will not be using him again, and we would not recommend him to anyone.
"I take a great deal of time before beginning a job by writing a contract with an extensive scope of work. I describe in detail the work I plan to do and the price. After I started this job, the member informed me that he wanted additional work to be performed. I told him this would require an additional day and a half of work by my crew, which I would be happy to do upon completion of a written change order increasing the price. He declined to pay any more for the work and I completed the job as defined per the contract. It was at this point that the member threatened to write a letter to Angie's List and to discredit me with his new neighbors. AS OF THIS DATE, THERE HAVE YET TO BE ANY FURTHER PROBLEMS AFTER OUR HAVING ADDRESSED ALL ISSUES BROUGHT TO OUR ATTENTION."
