glass repair

During the month of November 2010, our condo association contacted Philip Bendell at the recommendation of our roofer, with the intent to have our skylights repaired. Mr. Bendell sent us a proposal and quote on November 14, 2011 and made a presentation via conference call to our condominium meeting. His presentation was convincing and we accepted his proposal. He requested a down payment of $2,000 out of a total balance of $7,900 and we sent him a check. Although there were a couple more weeks of good weather in November and December, Mr. Bendell was unable to come and eventually winter came and it was not possible any more to do the job. When spring 2011 arrived, we started calling Mr. Bendell and asking him when he would be able to start the job. We called him several times through the spring and summer and he told us he couldn't do the work because his mother was dying. We accepted that excuse and waited until the end of the summer. At the end of the summer, we started to call him again in Sept and Oct. at least once or twice a week. He frequently picked up the phone and told us that he intended to do the job and even committed three times to coming to the condominium on a particular day. Even though we stayed home and waited for him, he did not come and did not even call us to apologize. In early November, we gave him a last chance and said that we would like our money back if he would not come by the end of the first week. He promised he would come on Friday, November 6, but again did not come. We then left him messages asking for our money and threatening legal and other punitive actions if he did not return our money. By then, he was not picking up our calls any more. It appears that Mr. Bendell never intended to do the promised job for us, rather he planned to pocket the down payment and then disappear. I believe Glass Act used to be located in Dorchester, so this review would relate to the Glass Act company in Dorchester as well.
Description of Work: Philip Bendell of Glass Act gave us a quote for the work. After we paid him the deposit he never showed up to do the work.
