I signed a contract on October 15, 2010 with Larry Fiore, C.A.F. Construction Company, 86 Mt. Lebanon Street, Pepperell, MA 01463, formally of Revere, MA. Contract stated he would furnish material and labor-complete and accordance with specifications according to plans created by Esoteric Residential Design Inc. for the sum of $107,OOO. Before signing I asked Mr. Fiore multiple times if the gas stove and stone for fireplace for the stove and bump-out in the front of the addition was included and he said yes, everything is included. He also told me that if anything we had discussed was not written on the contract that I should just write it in and not to worry about it. Immediately after signing the contract and giving him a check in the amount of $25,000 he told me to go buy the gas stove because he would need it right away. The gas stove sat in the store for over one year. He also told me I was going to have to pay for the stone. On July 14, 2011, in the presence of the Building Inspector, the designer and me, Mr. Fiore abandoned this project. Mr. Fiore told me there would be four people working on the project and he couldn't wait for the sub-contractors to get to the finish work so he could start his expert finish work. The only person who worked on the project, and that was very little, was Mr. Fiore and one other person. He NEVER contracted anything out. He charged me $6,300 to rent one jack hammer and remove a small amount of stone. It took them one week and he left a large piece of ledge and built a wall around it for my garage. When he left I had a professional drilling company come in which I had to pay a minimum of 4 hours and a trucking company which I had to pay a minimum of 4 hours to remove 5 times as much stone as Mr. Fiore removed. They arrived at 8:30 a.m. and were done at 11:00a.m. It cost me a total of $1700 to have it removed and hauled away and a total of 2 -1/2 hours. Mr. Fiore abandoned the job with incomplete excavation, removal of debris, my back yard looked like a dump site, incompletion of framing to meet code requirement, destruction of my existing property house, shed and patio. Mr. Fiore did not have insurance when he said he did, he was constantly verbally abusive, he overcharged for extra work, did not leave materials pre-paid for which was in the thousands of dollars. Mr. Fiore never told the truth. Mr. Fiore never showed up when he said he would be here and when he did show up, he was hours late and then he would think of some excuse and leave. Mr. Fiore left my roof open for months and the rain damaged the ceiling in my existing house. He constantly used the excuse that we had so much snow that year and even on July 14, 2011 he continued to say we had so much snow. When I signed the contract he told me the project wouldn't be complete for Christmas 2010 but would be complete shortly after Christmas.
Description of Work: Three cement walls foundation for garage, which had to be corrected, frame for floor above garage which was soaked on multiple occasions from downpours of rain frame for walls for family room above garage and frame for roof of family room which was not done to code and roof was not done to blue prints. All of which had to be redone by someone else. Frame for ceiling in family room was completely wrong and had to be redone. Mr. Fiore asked me for the second payment of $25,000 on December 8, 2010, which I gave him that day because he was going to pour the foundation on December 13, 2010. Garage walls were not poured until April 6, 2011. The contract was signed October 15, 2010 and Larry Fiore stated that the foundation would be sub-contracted out and he and one other person did the forms and did the guiding of the cement. It was not done correctly and had to be corrected.
