I, am a potential bidder for a property in Shrewsbury, MA (the “Property”). The property was listed as a sealed bid and purchase “As-Is.” However, potential buyers are allowed the conduct home inspections prior to submitting a bid.
Following is a list of events:
May 18, 2016:
I scheduled with Mr. Gregory J. Lemay to conduct the home inspection on May 18, 2016 at 9:00 AM at the Property. I informed Mr. Lemay that this is a bidding process and we planned to submit the bid by Friday, May 20, 2016. The realtor, the listing agent, my husband were all present during the inspection. The inspection ended prior to 11:00 AM.
Mr. Lemay walked through the exterior and then the first floor. Prior to inspecting the basement, he requested us to make payments and sign the Contract for Service. He promised to provide the home inspection report by the end of that day, May 18, 2016. During the inspection, I accompanied him the whole time and took notes. Please note that the Contract for Service stated the inspection was from 8:45 AM to 12:00 PM. However, he did not arrive until 9:04 AM and left prior to 11:00 AM. I believe this is misrepresentation and do not meet professional licensing code of conduct.

I did not receive the report by the end of May 18, 2016 and I called Mr. Lemay on May 19, 2016 at 11:01 AM. Mr. Lemay stated that he had a dinner party the night before and did not get to the report. He promised to email me the report by the end of May 19, 2016. I also sent Mr. Lemay an email to make sure he has my correct email address.

My realtor informed me that she is ready to submit the bid by noon that day. I told her that I still have not received the inspection report. I called Mr. Lemay at 8:55 AM to inform him that I need to have the report prior to submitting the bid. Mr. Lemay told me that he will be emailing me the report in 10 minutes. However, by 10:30 AM, my realtor has to leave her office to submit the bid. I still did not receive the report. I emailed Mr. Lemay and stated that his report did not provide any value as I could not review it prior to submitting the bid. I requested a refund of the inspection fee.

I did not receive any response from Mr. Lemay, either by phone call, text, or email. I called him at 10:08 AM and stated my request for a refund. He claimed that he had already emailed me the report. Later I double checked my email, I did not see his report. He was very upset on the phone and even called me “crazy woman.” I told him that his service did not meet the professional conduct requirements in CMR 266.6.00 and he did not treat me professionally. If he had experienced difficulty, I have given him enough time to produce the report. Per his website, the report was promised same day or next day. However, the report was not received more than 48 hours after the inspection. His failure to provide the written report caused me a lost of opportunity to obtain other home inspections prior to submitting the bid. I requested for a full refund again.

I still have not received the report nor the refund. I filed a complaint with the MA Licensing Board with all the receipts and documents and was assigned a docket # HI-16-015. I also filed a complaint with the consumer affair office to mediate on the refund process.
I firmly request Angie's list remove this provide from its listing, so that other consumers will not stumble on this kind of unprofessional services.
