Dave’s Pest Control has been in business in the Worcester area since 1972. Dave Penttila,Sr. started the company with little more than a handshake and a prayer. With that hand shake, pest control in Worcester MA was changed forever. Dave’s Pest Control is today still family owned and operated. Mr. Powers called back and started the conversation off by stating: and quot;that sounds good to us too.and quot; No apologies were offered; no offer to clean up the mess that they created was given. No offer to complete the bat exclusion of the barn was made. He stated that they would only refund the contract for the house that included the Guardian Protection Plan for $925 and $250 for bat exclusion for the house which both totaled $1,175. He refused to refund any of the $1,200 for the bat exclusion work for the barn. I then said that if he would not do that, then I may not be able to cancel with them because I would not be able to afford to hire another company. Mr. Powers said that continuing was no longer an option. He further stated that they will not come out to my property again. This meant not addressing the trapped and dead bats problems in the house and barn that they created, leaving the bat exclusion work for the barn incomplete, violating the one (1) year warrantee on the bat exclusion work, and leaving the bait stations that he had placed as a part of the Guardian Protection Plan on my property.
Dave's Pest Control committed the still living bats in the attic to die. The company subjected my family to an unhealthy situation with bats condemned to die to be in the attic creating toxic guano and subsequently health hazards associated with rotting bat corpses in the attic.
The bats in the attic have since died because we no longer hear movement or scratching in the attic or walls. There are bat carcasses on the inside of both metal screens at the front and at the rear of the attics. The bats had been trying to escape when they died. They have since been rotting there. After the bats have died, we have seen a surge in flies around our house and what may be flea like bugs on the interior of the house which have been biting us and our children. We believe that these may be flea like bugs (sometimes referred to as and quot;bat bugsand quot;) that are from the dead bats in the attic.
Additionally, there are now at least two bats living in the chimney connected to the oil furnace which were not there before Dave's Pest Control and R.MD. Services, Inc. performed the exclusion work. These bats are creating additional health hazards including bat guano collecting inside of the chimney.
Furthermore, bats have found a new entry point high up on one of the walls of the barn where Dave's Pest Control and R.M.D. Services did not seal. There have been no changes to the structure of the barn. That entry point existed when Dave's Pest Control and R.M.D. Services performed their work. The companies did not seal that entry point enabling bats to find it and use it. There are now many bats back in the barn which my wife and I have witnessed exit the barn. Therefore, the exclusion services of Dave's Pest Control for the barn were inadequate and are ineffective. Their refusal to continue services per their one year warrantee for the exclusion services results in a continuation of the original problem with bats in the barn.
I have since consulted with the Massachusetts Department of Health, the town of Brookfield public health representatives, and thus far informally with a representative of the Massachusetts Attorney General's office.
I have not yet consulted with the local or state police department or the Department of Environmental Protection or other such agencies concerning the violation of protection laws for bats in Massachusetts or with the better business bureau or other such agencies. However, those are separate matters and in no way bear on this civil case or demands herein.
Additionally, I have obtained verbal quotes from a hazardous waste clean-up company concerning costs with cleaning up the bat guano in the attic, another pest control company concerning costs for excluding the bats from the oil-furnace chimney and for excluding bats from the barn, and a chimney services company concerning costs for cleaning out the bat guano in the chimney and work necessary to perform that clean-up.
The combined estimate for the work described above with the exception of excluding bats from the barn totals $1,950.
The estimate for excluding bats from the barn is $1,200.
These amounts do not include medical costs or other for myself, wife, and three children.
The above constitutes damages that I have incurred as a result of Dave's Pest Control (including work performed by R.M.D. Services as a contractor for Dave's Pest Control).
Therefore, I hereby demand the following relief from Dave's Pest Control:
Payment of $3,150.
