It has now been nine months since this incident, and Mr. Neal still refuses to refund my money. Repeated letters and affidavits from my attorney, my landscaper and myself have been unsuccessful at resolving the matter, either with Merriam Materials or Discover Card. It appears that my only recourse is to stop making my monthly Discover Card payments when the balance falls to $1,430.72 plus accrued interest. I have not made any purchases with the card since this incident, and the card balance should reach that trigger point within the next few months. Until Discover Card sues Merriam Materials to recover their money, my refusal to pay them will damage my credit rating and FICO score, which normally hovers around 770... but that's a chance I'm willing to take. I adamantly refuse to pay for merchandise I never received, and I feel strongly that Mr. Neal's statement that the sale was voided trumps his company's "All Sales Final" policy. Buyer beware.

"Merriam Material Co., Inc. is a building material vendor, we do not provide services or offer contract labor for hire. We provided no services or installation labor to the member. Merriam Material Co has complied with all the terms contracted with the member regarding his order. We attempted delivery of the materials he purchased to his address on the date and time he requested. He refused delivery because we could not spot deliver his purchase inside the curb line. The member had a RV parked at his curb line. Like our delivery vehicle, it could not access his driveway because of low hanging tree branches. We comply with industry standards regarding delivery of building materials inside the curb line onto private property. We spot deliver only if we have adequate access to delivery area. His credit card company investigated this case and agreed we complied with our contracted obligations with the member. He refused all communications from us when we tried to resolve the delivery problem with this sale. Enclosed is a copy of the certified mail he refused to pick up after three attempts notifications by the U.S. Post office. Since we attempted delivery and the member refused to accept delivery, he may pick up his order at our business."

SALESPERSON WAS HELPFUL IN MY SELECTION OF STONES TO USE AND WAYS TO PLACE STONES. THE DELIVERY DRIVER WAS FRIENDLY AND POLITE. PLACED PALETTE ON DRIVEWAY.
