CH did not complete the job. There were many things left undone or improperly done. Charges on the bill exceeded the contract and verbal promises. We negotiated for days and were forced to settle with an amount we didn't agree to because of threats and the lien. Mr McIntyre relied on the contract to save him from verbal promises when it benefited him, but refused to comply with either when the result cost him money. We want $500 back for exterior repainting and $200 back for a color change. There were no written change orders, as the contract stipulates. Now that CH has received its money, it has even less incentive to correct its mistakes. This company was careless and irresponsible. They were late on scheduling things, which held up the work we were doing and scheduling ourselves and cost us additional money. They lost the key to our house and later left the house wide open with lights and radio on, completely unsecured. One group of subcontractors defecated in our barn. Although Mr McIntyre implies that this is a fabrication, we notified Tony Courtney as soon as we discovered it. He partially cleaned it up. CH did not provide a portable toilet for the workers. This violates OSHA and Health codes. CH was not always responsive. Subs frequently couldn't reach Tony Courtney and Carl McIntyre often did not respond for days or even at all to emails and calls. The final four weeks of the project, he discontinued all communication, much as TC had previously. The last contact we had was when I called Carl McIntyre weeks after our final payment had cleared and we had sent proof of that, but he was refusing to release the lien. He raised his voice and said I had been dishonest. That was not true, I was in no mood for further abuse from CH, so I hung up. CH made this a miserable experience for us. They demonstrated a complete lack of respect for us, our our property and the truth. They broke their own contract in order to get more money out of us, didn't finish the work and did an absolutely lousy job. The amount of stress they caused on us is unacceptable. Customers should never be treated the way we were. Carl even agreed, once apologizing for Tony Courtney, but later letting him do and say far worse. We are seeking $700 in charges that are not supported by the contract (no written change orders and verbally promised free work). We would also like an apology.
Response from CARRINGTON HOMES
"Carrington Homes has been in business for the past 16 years and has constructed over 200 custom homes for happy customers. We do very little advertising and rely on those good customers to refer us to their friends. The member is not a Carrington Homes customer. She originally contracted with a friend of mine. Prior to them signing a contract with him he closed his business. He asked me to run the contract through Carrington Homes. Mistakenly, I agreed to do so. While the contract is with C.H., the member was well aware of who she was doing business with. I have never met the member. I have spoken to the member a handful of times on the phone and responded to her emails promptly and with respect long after the project was started. Upon receiving emails from her, I would immediately contact the actual person responsible for the job and he would act appropriately to address her concerns. While I have no way to prove - nor does she - whether or not she was "cussed" at, I am confident based on what I know of her at this point, and what I've always known of the other company, that these allegations are simply false. She calculated the final amount due. It was far less than the actual amount due, however, the previous company agreed to take the lessor amount in an effort to bring a close to this nightmare. She has received well over $500 in credits for various items. We have an email trail that I am happy to provide to prove our case as it relates to the amount that was owed by the Lovely's. We gave them more time than is required by our contract to pay. She completely abused us throughout the process of completing her home and then told us that she could not pay. We still worked with her for a more than reasonable time period before concluding that the only way we would get paid is to exercise our right to file a lien. In our request for payment we asked for a certified check. She gave us a personal check which caused us to have to wait until the check was cleared before we could release the lien. If she would have simply sent a certified check, the lien could have been released 2 weeks earlier. At this time the lien is released and we have been paid the amount that the member said she owed. The house was left unlocked. We apologized for that and made every effort to not let it happen again. This is a common problem in new construction. Typically, the sub-contractors, the owner, and us work together to try to keep the home secure. We credited her money to re-key all the locks. I don't know what else we could have done in this situation. I have every email and do not recall one that references someone using the restroom in their barn. As with all the other situations that occurred, the previous company would have done what ever was appropriate to correct the situation had we been notified at the time it allegedly happened. I did not cease communication with the member at any point during this project. To this day, I am happy to address any of her concerns. I have email records to prove this is not a true statement. I have not ever called any customer a liar. It is not possible for the member to prove this statement since it is simply no true. I will be very disappointed if the member's complaint finds its way into your publication. I know there are plenty of poor quality contractors out there and feel that Angie's List provides a needed service. I have a 98 percent referral rate and can prove it. I have concluded that this falls into the 2 percent rule. I am being persecuted for either things we did not do, or that did not happen as she states them. For the credibility of your publication, please take advantage of my offer to review all the emails and the facts before printing anything negative about Carrington Homes. Sincerely, Carl S. McIntyre."
