On 2/8, we contacted Mr. Bradley by phone, and told him to prepare the Mutual Release, & we would be in that afternoon to sign. Bradley said he wanted to exclude 3 potential buyers & we agreed. Wife signed the Mutual Release afternoon of 2/8. Bradley told her that he couldn't do the exclusions as he had hoped. Bradley signed the Release w/o exclusions. He explained to wife "You understand if we get an offer Monday, I will get nothing." He confirmed to wife their contract was terminated that day. Homeowners signed with a Carmel Realtor 2/10, and new listing went up on MLS. Carpenter refused to take down their listing, and managing broker refused to sign release. They misrepresented to homeowners that the contract was closed as of 2/8, and drug out the cancellation process to 2/29. Managing broker, Phil Ludlow, refused to sign the release, but they didn't tell homeowner why until confronted 2/29. Nightmare experience!!
Description of Work: John Bradley and Carpenter, Lebanon, listed our home in Carmel for almost 5 months. With not even one offer in that time, we decided to cancel our listing in late January. John had 2 "good prospects" so we gave him 2 weeks to either close the deal, or we would cancel the contract. We thought we would have better luck listing with a Carmel Realtor, since the home was listed in the $700's and in Carmel. The original listing agreement had an additional condition we added, that the contract could be "terminated with a simple phone call." Both Mr. Bradley and the Carpenter broker signed this additional condition on the listing contract.
