"We were contacted by the Burkholders to investigate a problem in the crawlspace at the back of their home where water was undermining the foundation and washing mud into their crawlspace. He was trying to pump it out each time it rained. To repair this issue would be to re-do the foundation under the back of the house which was an area approx. 16'X30'; which meant we must support the back of the house while removing the existing foundation. The decision was made that since half of the crawlspace was already excavated; that putting in a basement would be a worthwhile sollution. On the east side of the main floor was a masonry fireplace, hearth & chimney which must be supported while we were excavating under it, and then pour a new footing and re-lay block up to the foundation of the fireplace. During the preliminary discussions with Mr. Burkholder, a decision was made to extend the basement further behind his house an extra 12' and pour a concrete patio over the basement that extended beyond the back of the house. A contract was signed according to those discussions. Since the house was built into the side of the hill; there was no physical access from the front of the property to the back of the house. Access was aquired through a housing addition and a farmers field into their backyard. Delays were encountered during the construction of this project with over 36" of rain spread out over the construction period. We did what we could do when the weather co-operated. At different intervals there were periods of times(sometimes a week or more) when we could not have access to the job. However; we had the footings and foundations completed except for some block on the back wall. I did temporarily cover the exposed patio area with concrete blankets, insulation and visqueen when winter set in. There was only a period of 21 days that the back of the house (including the chimney) that there was no footing or foundation under them. We did no work except maintain the exposed areas during the winter months. The next spring we finished laying the block on the south wall and poured the patio area by pumping the concrete from the street, because it was still too muddy. When it dried up enough where we could get access to the backyard again, we graded the whole area. When I presented my bill to the Burkholders, they said since the work wasn't done on a timely bases, they refused payment. During the time of delay on this project, customer extended to me additional payments beyond the 3 scheduled payments of the contract; but refused to pay the balance due when we completed the project in the spring of the next year. It has been more than 10 years now and they seem satisfied with the work I had performed. Sometimes, no matter how hard you try to please a customer; you always have those few you cannot satisfy.
