I've purchased several properties in the past, and this condo was by far, the most complicated! The seller moved to Italy, causing a series of issues. Fidelity National Title was outstanding in protecting my interests and making sure the transaction was fully legal and without problems. The seller had executed a Power of Attorney in the US to have his brother-in-law work on his behalf for the condo sale. However, because the seller was in Italy and not a US citizen, it caused problems and was not valid. Fidelity Title would not close without the proper documentation, and for that, I am extremely grateful. (The real estate agents suggested moving to a different title company that would let it go through, but I refused). So it took a month for the seller to actually bother to get the documents he needed in Italy. (He needed an apostille, or a notarized form from the US Consulate). When that arrived, it was only a fax copy, and the seal was not visible so the copy could not be recorded. Fidelity did offer a couple of suggestions that day, but we all agreed we needed the original, which was still in the mail. So I waited yet another week to get the original, and we finally closed! But that's not the end of the story! Because we had changed the closing so many times, the condo fees were late. So a month after closing I was assessed a late fee that the seller should have paid, and Fidelity should have known about. So I called the general manager, Justin Cochran, and he immediately looked it up, realized the error and said Fidelity would take care of it. It was only $35, but after all the other issues with the seller, I did not feel I should pick up the cost, and Fidelity stepped up, and took care of it immediately. I will use them for any future real estate transaction I have. They understand more than just local laws, and they are careful to protect themselves as well as the new owner.
