Kitchen and Bathroom Remodel

We contracted with Rich Pope to tile our small bathroom floor and install a new cabinet pantry in the kitchen along with a few other small jobs around our new house before then moving on to the large job of remodeling our master bathroom. He was supposed to do the smaller jobs in July and August of 2017 as he was able and then begin the larger bathroom job in September. It took several weeks for him to complete the tile and it wasn't quite done to the standard we expected. My husband took a day off of work and helped him switch out the kitchen cabinet and install a garbage disposal. He had previously cancelled showing up at the house 5 different times for various reasons and then when he was finally ready to start working on the master bath he was again a no-show. Having lost faith in his ability to complete the job in a timely manner and to our satisfaction we told him we wanted to cancel the request for work on the master bath and asked for a refund of our our unused deposit. He had originally given us a $9000 estimate for labor only (we were purchasing all material) and we had given him a $3000 deposit. Upon cancellation September 17th we asked for a $1450 refund and he agreed. After 3 weeks we hadn't received anything and asked again and he promised to send a cashiers check and "have us all taken care of" by the end of the month (October). It was not received. After contacting him again he sent $450 via Paypal with a promise of another payment the "next week". It was not received. On November 8th, after contacting him again he said he "should" be able to have something for us by the end of the week. As of this date we have still not received the last $1000 of our unused deposit back. He was given a grade a C on quality and responsiveness because the work he did with my husband's assistance turned out great but the work he did on his own was not as good. We could tell he cut corners and paid more attention to speed than quality. Responsiveness was given a grade of C because he always responded to us in a timely manner, but unfortunately half of what he told us was not true or followed through. On October 5th a complaint was made with the BBB and he was asked by them to respond within 2 weeks. He has not responded to them for possible resolution either. We are currently filing a small claims court against him.
