Mr. Phillips came out to estimate and provide a quote for doing the work on our house on July 2nd 2020. We sent him the signed contract and the down payment via mail on July 12th. We waited for several weeks, while Mr. Phillips said the materials were "special ordered" Initially he said 4-5 weeks for delivery of material. I checked in with him on July 27 when he told me the material would need 4-5 more weeks for delivery I checked in with him again on August 27 and he told me he would be starting on September 8th. I contacted him again on September 8th when he did not show up to begin the work, he said the materials still had not arrived. I contacted him several other times as well. On September 21 I contacted him again, he said he would be out to start the work on Thursday (September 24th) but again, he never came. I contacted him several more times and on September 29 he said he would be out on Friday October 2nd but again, he did not come. On October 3rd some materials were delivered to my house. On October 8th I contacted him via email and told him to come collect his material and return our deposit as we did not contract him to buy material for us only, the contract included installation. He says material was special order and he cannot return but this was not in the contract and we never discussed or agreed to this. So far he has returned $1500 dollars and he says the remainder is his payment for time and materials but again, we never agreed to this. I dont want the materials as I cannot install them myself. I need the money back and he can pickup his materials, I also left hiim another voicemail this morning saying exactly that. I asked Mr. Phillips for the invoice for the materials but he did not supply this either. He no longer returns my calls or emails and I am now concerned my association will fine me for the materials he left on my property.
