Marcin Krukowski/Andy Wujkowski commenced demolition and light construction without the proper permit so the City of Chicago issued a stop work order on 10/22/2008. Following extensive delays resulting from an ineffectual design that would not meet the city?s fire code, a permit was secured on 11/25/2008. Work resumed at that point and payments were made at the appropriate milestones per the agreement. On 02/08/2009, it is estimated that a balance of ~$5000 remained outstanding and, according to the agreement, was due at the completion of the project. As of this date six major items had yet to be completed (wood floor installation, brick installation, cement completion, air conditioner installation, construction of outdoor stairs for addition and construction of fence) and numerous smaller tasks (base board installation, wallboard repair, ceiling repair, painting, threshold installation) had been left unfinished. In a meeting on 02/12/2009 Andy Wujkowski requested that four of the five thousand dollars be paid immediately in order that the cement work and wood floor install could be completed. Based on a lack of faith in the contractor?s commitment to the job, resulting from previous work stoppages, $1700 was dolled. The wood floor was promptly installed and finished, yet another lengthy stoppage ensued. On 02/25/2009, after days of harassing, Andy Wujkowski provided a letter in which it was explained that an ADDITIONAL $8500 WOULD BE REQUIRED to complete the project. The reasons for the sum were stated as initial project estimates had been too low and unforeseen project issues had led to unpredicted costs. Quoting from the letter: ?The reason we are sending you the work order change, is due to a fact we were unable to correctly predict and calculate the total amount for the construction of your project?? We understand it?s a tough situation to decide on but, the reality of construction is thought these days and we are simply not able to put out 8,500.00 out of the company account to complete a project, simply because the price calculated in the beginning was to low.? The contract obligates Marcin Krukowski/Andy Wujkowski to complete all of the work at the initial cost. An attorney was employed by the Property Owners and on or about 03/06/2009 a letter was communicate to Marcin Krukowski/Andy Wujkowski that firmly reiterated the owners? feelings and intentions. Work has continued on the premise by other vendors as required and it is the Property Owners? intention to seek retribution for any monies that exceed the initial contract value. It has become clear that at least two subcontractors completing work for Marcin Krukowski/Andy Wujkowski have not been paid for work finished at 3906 N Francisco. Two separate parties (concrete and HVAC) have visited the project site and threaten the owners with placement of a lean on the property in order to secure payment for work completed.
Description of Work: The contracts called for demolition of old addition, construction of new addition, remodeling of first floor (kitchen, bathroom, dining area), removal of stucco, installation of siding, removal of radiator/boiler, and installation of furnaces and AC units. *** Actual work completed: Demolition of old addition - complete // Construction of new addition - framing completed, EXTERIOR UNFINISHED (no brick, no gutters), BASEMENT FLOOR NOT POURED, SIDEWALKS NOT POURED, sump pump not installed, plumbing for washer and utility sink not complete // Remodeling of first floor 80% complete // Removal of stucco/installation of siding - complete // Removal of radiator/boiler - complete but made a mess of the entire house in the process // Installation of furnaces - complete // Installation of AC units - two AC units never purchased, some preparation work complete but 90% INCOMPLETE
