We signed an agreement with Keith, the owner of the business on 8/31/07. He came back on 10-6-07 to put the plants in. We did 6 tons of rocks ourselves because he was taking too long and we had wanted done before the winter. 31 of the 48 plants died immediately after he planted them which was almost winter. When spring came, I called and called. He replaced some of the plants on 6/15/08. He promised to come out on 7/29/08 and didn't show which at that point our 1 year warranty was almost up and we had only seen 17 live plants for our $2900.He replaced some plants on 7/30/08 which the mounds were put in the back yard instead of the front. He would send workers when we weren't home. I called again on 7/30/08. I started faxing letters on 7/22/08, 7/31/08 and faxed and called on 7/24/08. He had told us in the beginning how he wasn't taking care of another customer because they didn't water the plants so we made sure we watered everyday. All the plants we put in are growing fine. He put in a different scotch pine than we originally agreed on. We live on a corner house and have had dead plants since we hired him for the landscaping job. We continually called and sent faxes.He came out of 7/10/09 and I taped him because at that point we didn't trust him. Here it was 21 months later and we were still waiting for one live scotch pine and flower plants in the butterfly garden which was supposed to be a Hummingbird Garden. He said it would be no problem to replace the flowers and he would replace the scotch pine again in the fall. He never did. He never came. Our son was in a car accident of 7/19/09, his arm was severed off, his colon twisted among numerous other injuries. He spent a month in Trauma ICU and another 3 weeks in a rehab after 6 surgeries and 2 more to go. Our top priority was keeping our son, Keith alive. I called in November 2009 with no response from him. I talked to his secretary, sister-in-law Linda. Our landscaper, Keith never showed up to take care of anything. Come spring of 2010, I started calling and faxing and he never responded. His wife Tracy said she thought he wasn't going to do it and to date hasn't.
Description of Work: I was supposed to get a hummingbird garden and some bushes. They advertised "The Private Garden Retreat" you have always wanted. We got a butterfly garden which still hasn't bloomed. Most of the plants never even came up. We have a $175 dead scotch pine with promises to replace, we even taped him saying he would replace it in October of 2009, we are still waiting. He put the silver mounds in the butterfly garden instead of the front yard as promised and they all died that was $42. His wife, Tracy, now says she thought he wasn't replacing. We have been waiting two years and have been more than patient.
