THE PROBLEM HAPPENED WHEN THE GUTTERS WERE LEFT OFF THE HOUSE FOR 15 DAYS DURING A VERY RAINY PERIOD. THERE WAS INITIALLY SUPPOSED TO BE AN ENTIRE CREW ON MY JOB, BUT THE SUBCONTRACTORS WERE UNAVAILABLE AND THE CO-OWNER DECIDED HE WOULD DO THE WORK SOLO. I WAS TOLD DURING THE INITIAL CONTRACT SIGNING THAT THEY WOULD WORK IN THE RAIN, BUT BOB (CO OWNER) DECIDED THAT HE WOULD NOT. IN THE MEANTIME BOB WAS INJURED OFF THE JOB. THIS EXTENDED THE JOB DUE TO RAIN AND INJURY UNTIL THE SUBCONTRACTOR CREW WAS AVAILABLE FOR TWO WEEKS. THIS CAUSED EXPENSIVE FLOODING IN MY FULLY FINISHED BASEMENT. I WOULD LIKE THEM TO PAY 1/2 OF THE REPAIR COST (THAT I HAVE KEPT TO A MINIMUM) DUE TO THE FLOODING. SINCE THE NEW GUTTERS WERE INSTALLED, THERE HAS BEEN TWO WEEKS OF RECORDS BREAKING RAINFALLS WITH NO PROBLEMS.

While I feel sorry for the member's unfortunate basement leak. We as a company assume no responsibility for the water that entered their basement. As per a copy of the signed contract, it clearly states the company is not responsible for damages due to rain or other weather issues or the availability of labor. The member is fully aware a very unusual rain occurred; over 1.5" of rain fell in under an hour. Furthermore the grade on the member's home is not graded properly as it slopes toward the home, trapping water. The water entered a basement window well that does not have drains installed. As a contractor for many years, it is my expert opinion that a basement should not leak even if gutters are installed or not. Therefore the member's have a problem that was pre-existing and had nothing to do with the performance of the work that we completed on the member's home. The member had told me that the basement had leaked once before, so he was aware of the risk. Robert Cramer, President
