"I am in receipt of and have reviewed the complaint submitted to Angie’s List by [member name removed], with respect to a credit card payment to Big Earth landscape Supply, Inc. (“Big Earth”). Please be advised that Big Earth was retained to provide labor and materials to real property owned by Aim Industries, LLC. The scope of the labor and materials to be provided was contained in a written quotation provided to the owner. A review of the scope of work reveals, importantly, that drainage was not part of the work to be provided by Big Earth. More specifically, the owner indicated an intent to utilize the property for a paintball business and was requesting that Big Earth level, grade, and seed three fields in order to be used for that purpose. The owner also conveyed that minimizing cost was paramount. The property itself is designated as lowlands by the Hillsborough County Property Appraiser and the owner had experienced flooding problems in the past. Big Earth was crystal clear with the owner that it was not being retained to resolve or correct flooding issues but, instead, to level, grade, and seed the designated fields, as well as provide fill materials to the drives. It appears that the owner is no unhappy with the fact that the property continues to drain in the same manner as it did prior to the leveling, grading, and seeding of the fields, and filling of the drives. However, again, drainage was not within the scope of Big Earth’s work. In accordance with its scope of work, Big Earth provided 23 truckloads of fill dirt to the property. Additionally, it provided 58.13 tons of crushed asphalt in the drives on the property. The owner contested the credit card charge for the work and materials after the fields flooded from heavy rains. Ironically, in that process the owner raised a variety of complaints that differ substantially from those of which it now complaints. It appears that the owner will say or do anything to disparage Big Earth, regardless of any factual support. Big Earth strives to provide superior customer service and quality materials and work to its customers. It is regrettable that the owner has drainage issues with respect to the property, but there is no question that Big Earth fully performed all work and provided materials as set forth in its contract. Big Earth cannot be responsible for conditions which previously existed on the property, and which it was not retained to address."
